1. GENERAL

These Terms apply to your access and use of the Astro StockLink Services ("ASL Service"), owned and operated by Measat Broadcast Network Systems Sdn Bhd (Company No.: 240064-A) (“MBNS”).

By accessing the ASL Service you agree to be bound by the Terms set out below. These Terms are subject to changes and such changes shall be made available on the Astro Web Site. It is your responsibility to check for updates.

You agree that the terms and conditions contained in the Astro Subscription Agreement still continue to bind you and you shall continue to adhere to those terms and conditions.

References to ‘you’, your’ and ‘yours’ are references to Subscribers of Astro Services.

DISCLAIMER
The ASL Service is provided "as is" and "as available", without any warranty of any kind, either express, implied or statutory. To the fullest extent permitted by law, MBNS does not warrant that the ASL Service will be provided uninterrupted or free from errors or that any identified defect will be corrected and that the information on the ASL Service is accurate, complete, timely or reliable. MBNS expressly disclaims liability for any delays, errors or omissions in the transmission of content/information. The material provided herein is for informational purposes only. Nothing on the ASL Service is to be construed as an offer or solicitation to sell or buy securities or other financial instruments, or as advice or recommendation with respect to such securities or other financial instruments.

EXCLUSION OF LIABILITY
MBNS shall not be liable for any direct, indirect, special consequential, incidental loss, damage, cost or expense of any kind, resulting from the use or inability to use the service, whether arising under contract, tort (including negligence) or otherwise resulting from the use or inability to use the service or resulting from any material and/or data downloaded or obtained or goods and/or services purchased or otherwise obtained via the use of the ASL Service including (without limitation) loss of production, loss of or corruption to data, loss of profits or of contracts, loss of operation time and loss of goodwill and anticipated savings, even if MBNS has been advised in advance that such loss may occur.

NOTE
When the Kuala Lumpur Stock Exchange (“KLSE”) is open, stock and fund quotes are at least 20 – 30 seconds delayed. When the KLSE is not open, quotes are only current as of the close of the last day of trading. Before selling or buying any stock or other investment you should consult with a qualified broker or other financial professional to verify pricing information.
 
2. DEFINITIONS

(a) “Astro Services” means the various packages of television and radio channels made available to you by MBNS under the service name of Astro.
(b) “Astro Stock Link Services” means the KLSE stock price information services made available by MBNS to you via the Astro Services (“ASL Service”).
(c) “Astro Subscription Agreement” means the subscription agreement that governs your use of the Astro Services.
(d) ”Astro Web Site” means the web site located at www.Astro.com.my
(e) “Subscribers” means the subscribers to the Astro Services
(f) “Service Fee” means the fee payable by you to MBNS for the ASL Service.
(g) “Terms” means these terms and conditions and any amendments and/or variations thereto for access to and use of the ASL Service.
 
3. ELIGIBILITY FOR THE ASL SERVICE

i) The ASL Service is only available to Subscribers with Astro Services.
ii) MBNS reserves the right to reject or accept any application for the ASL Service at its sole and absolute discretion. Where MBNS rejects an application, it shall not be obliged to provide any reasons or explanation for such rejection.
 
4. SERVICE FEE

The Service Fee payable by you will be billed in accordance with the current billing cycle in your Astro Subscription Agreement. The payment terms and obligations with regards to the Service Fee shall follow those contained in the Astro Subscription Agreement.
 
5. COPYRIGHT AND TRADEMARK NOTICES

All ownership rights, copyright, trademarks and other intellectual property rights attaching to, contained or vested in the ASL Service and all data, information, details, materials, literature, manuals or graphics contained in the ASL Service are properties of MBNS unless otherwise indicated. MBNS strictly prohibits use of its copyright by any means or its trademarks in any manner without express prior consent.
 
6. INDEMNITY

You hereby agree to indemnify and keep fully indemnified MBNS, its employees, agents, and contractors against any action, claim, demand, expenses (including legal fees on a full indemnity basis) suffered or incurred by MBNS arising from your use or misuse of the ASL Service; your breach or non-observance of the Terms; and infringement of rights of any third party in conjunction with your use or access to the ASL Service.
 
7. SUSPENSION AND TERMINATION

MBNS may in its sole discretion and without any liability to you suspend or terminate access to the ASL Service at any time for any reason whatsoever. Your access to the ASL Service will automatically terminate if your Astro Subscription Agreement is terminated in accordance with the provisions contained therein.
