ASTRO MOBILE GENERAL VOTING TERMS AND CONDITIONS

  1. The Voting Mechanics and Eligibility

    1. The En Video Voting("Voting") shall be held from 17th May 2008 to 6th August 2008 for Stage 1 and from 27th September 2008 to 8th October 2008? for Stage 2 ("Voting Period") and will close at the end of the Voting Period or such other time that Astro shall decide from time to time. Entries received after the stipulated time will be ineligible for the prize.
    2. Wherever applicable, the Voting Block during the Voting Period shall be as follows or such other time that Astro shall decide from time to time:

    3. The Voting is open to subscribers of prepaid and post-paid services of Maxis, DiGi and Celcom providing Short Messaging System ("SMS") services in Malaysia and where applicable users of Telekom Malaysia fixed line ("Voters").
    4. To enter the Voting, the Voter must request for questions by keying in EV<space>Clip ID and send to 32777 ("Voting Entries").
    5. The Voter must be an Astro subscriber and a Malaysian citizen.
    6. The Voter can send in as many Voting entries as they wish.
    7. Voters will be charged a premium charge of RM0.50.


    STANDARD TERMS AND CONDITIONS

  2. Charges
    1. Each Voting entry sent by the Voter will be subject to a premium charge as stipulated. This charge is in addition to the standard fee charged by the Voter's respective telecommunications service provider.

  3. Voting Entries
    1. The Voter must ensure that their Voting entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified.
    2. Astro reserves the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.
    3. All Voting entries must be submitted in the language specified. Voting entries in any other languages will be rejected by Astro.
    4. Employees of ASTRO ALL ASIA NETWORKS plc ("Astro" including its subsidiaries and affiliates, sponsors, agencies, dealers, retailers and their immediate family members are not eligible to participate in this Voting.
    5. Voters under the age of eighteen (18) must seek parental and/or guardian approval before participating in the Voting. Astro considers it the responsibility of parents and/or guardian to monitor their children's participation in this Voting.
    6. Where applicable, Voters must obtain consent from the bill payers before participating in the Voting. Payment shall be made irrespective of whether such charges were authorised by the bill payer. For the purposes herein the term "bill payer" shall mean the individual, company or entity specified in the registration or subscription form whose application for the relevant service has been approved and accepted by the service provider.

  4. Proof of Receipt
    1. Proof of SMS sent by a Voter does not denote proof that the SMS was received by Astro.

  5. Publicity
    1. Astro reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Voting winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Voting winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.

  6. Use of mobile numbers
    1. Astro and/or its affiliates reserve the right to send SMS messages to the Voters mobile phone numbers containing information and promotional activities regarding any other Astro promotions.
    2. If a Voter does not wish to receive such SMS messages the Voter is required to call and inform Astro accordingly by calling Astro's call centre at 1 300-82-3838

  7. Adherence to Voting Terms and Conditions
    1. All Voters shall be required to adhere to the Voting Terms and Conditions and the Astro Website Terms of Use and Notices including any changes made thereto. Astro reserves the right to forfeit the prize(s) in the event any of the Voting Terms and Conditions and/or the Astro Website Terms of Use and Notices are not adhered to.

  8. Variation to the Terms and Conditions
    1. Astro reserves the right to change, amend, delete or add to these Voting Terms and Conditions without prior notice at any time and the Voters shall be bound to such changes.

  9. Liability
    Astro will not be responsible or liable for:
    1. any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating telecommunication service provider and/or by Astro and/or resulting from participation or the downloading of any materials in the Voting. In the event of such error, interruption and/or failure, Astro shall not be responsible or liable for any failure by any Voter to participate in the Voting at any time.
    2. any problem, damage or loss of whatsoever nature to any Voter, or their authorised representatives resulting from their participation in the Voting.
    3. any error (including error in notification of Voting winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

  10. Disqualitification
    1. Astro reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Voting, to be acting in breach or potential breach of these Voting Terms and Conditions and/or the Astro Website Terms of Use and Notices. No correspondence shall be entertained.

  11. Suspension
    1. Astro further reserves the right to cancel, modify, suspend or delay the Voting for any reason whatsoever.
